1. General terms and conditions

1.1 These terms and conditions of use of the Bellfire OÜ e-shop apply to customers who are natural persons.

1.2 Legal entities may also make purchases from the Bellfire e-shop, but they are not subject to the rights of consumers set out in the Terms of Use.

1.3 The owner of the e-shop and the contracting party to the sales contract is Bellfire OÜ (registered at 11141324), with registered office at Riia tn 142, Tartu 50411 (hereinafter referred to as “Bellfire”), Email: bellfire@bellfire.ee.

1.4 Bellfire reserves the right to amend these Terms and Conditions by notifying purchasers thereof on Bellfire’s website www.bellfire.ee. If the customer has submitted his order before the entry into force of the modification or amendment, the legal relationship between the customer and the seller shall be governed by the General Terms and Conditions, price lists and other related terms and conditions in force at the time the customer submits his order, unless otherwise provided by law or these General Terms and Conditions.

1.5 Any modifications shall not be applied retroactively.

1.6 Photographs displayed on the E-shop are illustrative, the goods may in reality differ from those depicted in the photograph. The colour tone of the product may differ from the actual product due to the settings of the display. The dimensions of the products may differ +/- 3cm from those described as they are handmade products.

1.7 The copyright in the photographs, texts and other materials on the Bellfire e-shop belongs to Bellfire or its partners.

1.8 The use of Bellfire e-shop photos, texts or other copyrighted works for commercial purposes is not permitted.

1.9 In the event that the ordered goods cannot be delivered due to the expiry of the goods or for any other reason, the Buyer shall be notified as soon as possible and the money paid (including delivery costs) shall be refunded immediately, but not later than 14 days after the notification.

1.10 The Goods shall remain the property of Bellfire OÜ until delivery to the Customer.

2. Prices, ordering and payment

2.1 The prices of the Products on the Bellfire website are in Euro.

2.2 All prices are inclusive of value added tax (VAT) in the Republic of Estonia.

2.3 Once you have selected the appropriate goods and added them to your shopping basket, you can choose the appropriate delivery and payment method.

2.4 Payment methods are:

2.4.1 By invoice. 2.4.1.1. by invoice. You will be contacted and sent payment information when your order is confirmed.

2.5 A sales invoice will be delivered to you with the goods.

2.6 If necessary, it is possible to specify a different delivery address to the address of the invoice recipient.

2.7 A confirmation of the order (“Order Confirmation”) will be sent to the Customer at the email address provided by the Customer in the Order.

2.8 Bellfire OÜ does not offer a hire purchase service for the purchase of Products. For payment of the Products, the advance payment shall be 30% on the Order Confirmation and 70% immediately prior to receipt of the Goods.

3. Delivery of goods

3.1 Goods ordered from the e-shop can be collected by picking up the goods yourself or by selecting the delivery method of your choice in the shopping cart.

3.2 Delivery methods are:

All delivery prices apply to a single product. All delivery prices are based on the price of the product.For more products, please contact us and the delivery price will be agreed. For all orders outside of Tartu and Harjumaa the price is subject to agreement.

All delivery methods are subject to easy access to your plot/house/floor/room.All deliveries are subject to the following conditions. If the product does not fit in the dimensions of the hallway/door of the house, or if the drive to the house is inaccessible (driver’s assessment), Bellfire will not be responsible for non-delivery and new transport arrangements and costs. (Please ensure that the product will fit through the front door and hallways of the residence before placing your order. If the product does not fit inside, Bellfire will not be responsible for transportation to the room and no refund will be given. Also, the product cannot be returned for this reason.)

3.3 You will be contacted prior to dispatching the goods in order to agree on the exact time of delivery.

3.3.1 Delivery of the Goods will only take place once the full amount due under the Order has been credited to Bellfire’s account.

3.3.2 For deliveries outside of Estonia, special charges may apply, which will be advised by the shop when the order is confirmed.

4. Deadlines for fulfilling the order

4.1 Orders placed over the weekend will be processed on the first working day of the new week.

4.2 Orders will be delivered according to the date of order confirmation (+/- 7 days). Delivery time for in-stock fabrics is up to 4-6 weeks. We will inform you of the exact delivery time by telephone or e-mail within three working days of placing your order.

5. Modification or cancellation of an order

5.1 After receipt of the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. Depending on the products, the purchaser may not have the right to withdraw from the contract, and the products and services in question must be listed and meet the conditions listed in Section 53(4) of the Law of Obligations Act.

5.2 No changes may be made to orders later than 48h after the order has been placed and confirmed by the Company (Exceptionally or by agreement may be possible but may incur additional charges).

5.3 Receipt of an Order Confirmation by e-mail is confirmation from us that we will manufacture the Product and that it has been purchased.

6. Right of Withdrawal and Return of Goods

6.1 The Buyer has the right to withdraw from the sales contract concluded in the e-shop and return the goods purchased from the e-shop within 30 days of receipt of the goods. The withdrawal period expires 30 days after the day on which the goods are delivered to the buyer.

6.2 The Buyer shall submit a free-form application for the return of the goods. The Buyer shall send the return declaration to Bellfire by e-mail to bellfire@bellfire.ee no later than 30 days after receipt of the goods. The e-mail must contain information on the goods to be returned, the order number and the account to which the money is to be credited, and, if possible, the reason for returning the goods.

6.3 The Buyer must return the goods referred to in the notice of withdrawal within 30 days from the date of submission of the notice of withdrawal at the latest. The goods can be returned to our factories or to our representative warehouse in Tartu (by agreement). The goods can also be sent by own transport:

6.4 Costs related to the packaging and return of the returned goods shall be borne by the Buyer.
6.5 The Buyer has the right to inspect the goods ordered from the e-shop in a manner that allows him to familiarise himself with the nature, characteristics and functioning of the goods. In order to ascertain the nature, characteristics and functioning of the goods, the goods may only be handled and used in the manner normally permitted in a shop. Goods to be returned must be unused. The buyer shall be liable for any depreciation in the value of the goods resulting from any use of the goods other than that necessary to ascertain the nature, characteristics and functioning of the goods. The purchaser must examine the goods carefully, open the packaging without damaging it if possible, and not remove labels/protective labels, etc., if the goods are used for purposes other than those for which they are intended. The buyer shall be liable for any depreciation in the value of the goods on their return (including the cost of repackaging, etc.).

6.6 The returned goods and the accompanying documents (instructions, warranty conditions, etc.) must be undamaged, complete, in their original packaging and unused. In the event that the returned Goods, the accompanying manuals and other documents and/or the packaging of the Goods have deteriorated due to circumstances for which the Buyer is responsible, Bellfire shall be entitled to reduce the refundable charge in proportion to the reduction in the value of the Goods.

6.7 When returning the Goods, the Buyer shall be obliged to package the Goods in such a way as to ensure their preservation. If the value of the goods has been reduced during the return, the Buyer shall be liable for this.
6.8 The Buyer has no right of return:

6.8.1 the service ordered and already provided;

6.8.2 Goods which have been made or adapted to the Buyer’s wishes (e.g. an order for soft furniture or a mattress finished with fabric at the customer’s request, an order for a mattress of a special size). According to § 53(4)(2) and (3) of the Law of Obligations Act, the 14-day right of withdrawal and rescission for distance contracts does not apply to contracts for: (2) the supply of goods made to meet the personal needs of the consumer party to the contract; (3) the supply of goods made to the specifications of the consumer;

6.8.3 goods which, by their nature, are mixed or combined with other goods after delivery in such a way that they can no longer be separated.

6.9 In the event of cancellation of the order or return of the product, the amount paid for the purchase shall be credited to the bank account indicated by you within 14 days at the latest from the date of cancellation of the order.

6.10 Refunds will be made using the same method of payment used by the Buyer to make the payment, unless otherwise agreed by the parties.
6.11 Goods can only be returned at the place and in the country of purchase (e.g. if the goods were purchased in Estonia by a citizen of the Republic of Estonia, the goods can only be returned in Estonia).

6.12 The Buyer undertakes to check the quantity and quality of the goods at the time of delivery. The Seller must be notified immediately of any defects found. If it is not possible to check the condition of the product at the time of delivery, the Buyer undertakes to notify the Seller of any visible defects in the product before installation, but not later than 7 days (2 months in the case of consumers) after delivery of the product to the Buyer. Any subsequent complaints about visible defects in the product will not be accepted.

6.13 There is no right of return for Goods which have been manufactured taking into account the personal needs of the consumer party to the contract or which have been manufactured in accordance with the conditions specified by the consumer. In the event of withdrawal from the contract, the consumer shall bear the normal costs of returning the goods covered by the contract.

6.14 If the goods are not in conformity with the terms of the contract and the seller is liable for this, the customer may pursue legal remedies against the seller. In particular, the customer may require the repair or replacement of the goods, provided that this is possible and reasonable and does not involve unreasonable costs. Instead of repair, the seller may replace the goods with a replacement that complies with the terms of the contract. If the seller replaces the defective good with a good which complies with the contract, the seller may require the customer to return the defective good.

7. Guarantees

7.1 The warranty period of the Product is 2 years and takes effect from the date of delivery of the Product to the Customer and is valid only upon presentation of the invoice evidencing the purchase of the Product.

7.2 The warranty is valid on the territory of the Republic of Estonia, i.e. at the place of purchase. In this case, in mainland Estonia. If the purchased goods have been taken to another country after delivery (or to small islands in Estonia), the buyer is responsible for the costs and arrangements for returning the goods. The product must be returned to the factory or shop). The purchaser is responsible for the inspection of the goods immediately upon receipt at the place of purchase/receiving address.

8. Return of non-conforming goods

8.1 In the event of a defect in the Goods, please stop using the Goods immediately and notify Bellfire of the defect immediately.

8.2 Bellfire shall not be liable for any defects in the Goods caused by improper or incorrect installation, use and/or maintenance (sitting on armrests, jumping on sofas, wear and tear/change in appearance of fabrics due to washing of non-washable fabrics, unmaintained flapping of mattresses in the case of feather mattresses, etc.).

8.3 Bellfire shall not be liable for any defects in the Goods caused by normal wear and tear of the Goods (including fabric curling, topstitching, mattress shape sagging, fabric fraying, colour fading, softening/loosening of downholstery).

8.4 If you have any questions, problems or complaints, please contact Bellfire’s e-shop customer service at bellfire@bellfire.ee.
8.5 In the event of a defect, the Buyer shall have the right to contact Bellfire OÜ within two months by sending an e-mail to bellfire@bellfire.ee or by telephone to +372 614 0207. Bellfire shall respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days. Bellfire OÜ shall not be obliged to settle claims submitted after two months from the date of the defect.

8.6 After the customer has placed an order in Bellfire’s e-shop, the seller has the right to refuse to deliver the ordered goods or to provide the service, and to refund to the customer, no later than 10 days from the date of the problem, the fee paid by the customer to the seller for the order, if:

8.6.1 the price or availability of the ordered product has changed significantly for the seller after the order has been placed;

8.6.2 the order is placed on the basis of incorrect information that was published on Bellfire’s website due to human error or technical failure (for example, if the price of the product was incorrectly stated as €25 instead of the actual price of €250).

9. Dispute settlement

9.1 Disputes shall be settled in accordance with the law of the Republic of Estonia.

9.2 Disputes between the Buyer and Bellfire shall be settled by negotiation. If Bellfire has refused to satisfy the Buyer’s complaint or if the Buyer does not agree with the proposed solution and considers that his rights have been violated or his interests have been harmed, the Buyer may file a complaint with the Consumer Disputes Committee (at the address Pronksi 12, 10117 Tallinn or by e-mail at avaldus@komisjon.ee) or with the court.

9.3 In addition to the foregoing, the Buyer has the right to use the Online Dispute Resolution (ODR) platform http://ec.europa.eu/odr to resolve any dispute arising from the goods or services purchased from the e-shop. The ODR platform is primarily intended for cross-border disputes, allowing the Buyer to more easily find the appropriate out-of-court entity in the trader’s Member State to resolve a specific dispute.

9.3 In addition to the foregoing, the Buyer has the right to use the Online Dispute Resolution (ODR) platform http://ec.europa.eu/odr to resolve any dispute arising from the goods or services purchased from the e-shop. The ODR platform is primarily intended for cross-border disputes, allowing the Buyer to more easily find the appropriate out-of-court entity in the trader’s Member State to resolve a specific dispute.
